中国××杂技团赴××国演出意向书

中国对外演出公司(以下简称甲方)与××国演出公司(以下简称乙方)就中国××杂技团(以下简称该团)赴××国演出,达成如下意向:

一、应乙方要求,甲方同意安排该团于××××年×月×日至××××年×月×日在××国演出。乙方应于××××年×月×日以前将演出日程安排通知甲方。

二、该团由××人组成(××名演员,1名领队,1名翻译)。演出节目由甲、乙双方共同商定。

三、在访演期间,每天最多演两场,每场两小时(包括休息时间);每周最多演9场,每周休息一天。旅途超过三小时的当天不能作休息日计算,亦不能安排演出。

四、甲乙双方都不承担与协议条款不一致的义务和责任。除根据协议规定的演出外,该团将不在所访国作其他正式演出。

五、乙方同意支付该团在访演期间的下列费用:

1.该团全体人员的往返旅费和演出道具的往返运输费。

2.该团在所访国国内交通费。

3.旅馆费。×个套间,×个单间,××个双人间。旅馆应符合标准,所有房间均有洗澡间和卫生设备。

4.伙食费。伙食标准,每人每天按××美元发给,伙食由该团自理。乙方每周星期一向该团代表预付本周费用。

5.医疗费。包括住院、手术、护理、药物等费用。

6.保险费。包括该团全体成员的人身和行李及演出道具的保险费。

7.与演出有关的一切税款。

8.所有海关费用,签证费,入、出境费和机场费。

9.该团全体成员生活服装洗涤费(每周一次)和各类小费。

10.因工作需要拍发的电报、电话费。

11.演出杂费。包括提供部分不宜携带和经协商不必携带的演出器材,如布景、大幕、地毯、音响设备、基本灯光等,以及演出器材、布景、道具等修理费(包括修理所需之材料费)和演出的服装洗涤费。

12.为演出的排练提供设备良好的剧场和舞台工作人员。

六、演出报酬:

1.按演出天数计算,乙方付给甲方每天演出费晚场××××美元,日场××××美元。乙方同意每周付款一次。演出费汇至:

中国对外演出公司,北京,中国银行总行营业部,帐号71401385。

2.经甲、乙双方同意,对该团演出节目可拍摄电影、录像、电视转播等,所得收入对半分成,即甲、乙双方各得百分之五十;在其他国家转播,其收入总额的百分之七十归甲方,百分之三十归乙方。

七、该团在抵达往访国前作好排练和演出的准备工作。访演期间,乙方提供必要的排练场地。

八、如果由于该团某种原因不能演出,乙方不支付协议第六条第1款规定的费用;如果由于乙方某种原因不能演出,乙方仍应按协议第六条第1款的规定付款。

九、甲方向乙方提供该团简介、主要演员及演出节目介绍、剧照等有关资料。上述资料(包括乙方拍摄的资料)只能在此次演出中作宣传广告用,不能作其他用途。

甲方向乙方提供全团名单(姓名,性别,出生年、月、日,出生地点,职务,护照号码)及器材物资清单(物资名称、体积、重量、价值)。

十、甲方同意该团人员接受报纸、电台、电视台等新闻机构有关宣传报道演出的采访。

甲方同意拍摄不超过三分钟的宣传镜头。如专门安排拍摄,乙方应向甲方支付劳务费。未经甲方同意,演出期间禁止拍照、录像、录音。

十一、乙方同意在访演期间为该团安排一些参观、游览和文艺活动,并支付有关费用,乙方也愿意为该团要求安排的其他友好活动提供方便。乙方同意在有中国代表机构的地方,向该团提供××张首演免费入场券,其他场次每场免费提供××张。

十二、甲方负责办理该团人员和演出器材等出、入中国国境的一切手续;乙方负责办理该团人员和演出器材等入、出××国国境的一切手续。

十三、在所访国演出过程中,由于双方无法控制的原因,如天灾、战争、流行病、罢工、国内动乱等,而导致演出推迟或中断,双方都不承担停演责任。在上述情况发生时,乙方应负担上述条款中规定的生活费,如因此而不得不取消以后的演出,乙方应尽快安排该团返回本国,费用由乙方负担。

十四、甲乙双方同意本着友好协商原则,就有关具体事宜进一步磋商,争取尽早签署演出正式协议书。

十五、演出正式协议书一经双方签字,乙方应立即向甲方支付×万美元定金,用于该团装备开支。双方应共同遵守协议书;任何一方违约,将付给对方损失费×万美元。

正式协议书构成双方的全部谅解,不能以口头形式更改。如有异议和未尽事宜,双方应本着友好协商精神解决。

正式协议书自签字之日起生效,至协议书所规定的义务全部履行完毕为止。

正式协议书一式两份,每份都用中文和英文写成,两种文本同等作准。(此处空4-6厘米)

LETTEROF INTENT

FOR THE PERFORMING TOUR

BY

…ACROBATIC TROUPE OF CHINA

IN…(COUNTRY)

China Performing Art Agency(hereinafter referred to as Party A)and…Performing Art Agency of…(hereinafter referred to as Party B)have tentatively reached the following agreement on the performing tour by…Acrobatic Troupe of China(hereinafter refer red to as the Troupe)in…(country).

1.At the request of Party B,Party A agrees to send the Troupe on a performing tour to…(country)from…(date)to…(date)Party B shall inform Party A of the schedule of the tour no later than…(date).

2.The Troupe consists of…persons(…Performers,one group leader and one interpreter).The items on the programme shall be decided between the two Parties through consultation.

3.During the tour,there shall be no more than two performances a day and nine a week with each performance lasting no more than two hours(intermission included).There shall be one day off each week.No performance shall be arranged on the day when.the Troupe travels for over three hours.That day shall not be regarded as an off day either.

4.Neither Party A nor Party B shall undertake any obligations or responsibilities inconsistent with the provisions under the agreement.Party A agrees that the Troupe shall not give other formal performances during the tour in the host country than those specified in the agreement.

5.Party B agrees to bear the following expenses of the Troupe during the tour:

(1)Two-way travel expenses for all Troupe members and props transportation expenses.

(2)Transportation expenses of the Troupe in the host country.

(3)Hotel expenses which shall cover…suites,…single rooms and…double rooms.The accommodation shall be up to standard,with bathrooms and sanitary installations.

(4)Board expenses at the rate of…U.S.dollars person/day which shall be delivered in advance once a week on Monday to the representative of the Troupe.

(5) Medical expenses, including expenses for hospitalization.operation. nursing,medicine,etc.

(6)Insurance premium,including life insurance premium for all Troupe members and insurance premium for their luggage and props.

(7)All taxes relating to the performances.

(8)All customs charges,visa tees,entry and exit fees and airport fees.

(9)Laundry fees for daily wears of all Troupe members(once a week)and tips of all kinds.

(10)Telegramme and telephone charges for business purposes.

(11)Miscellaneous expenses relating to the performances,such as expenses for stage equipment like setting,curtain,carpet,audio system.basic lighting units etc,which are not suitable or not necessary as agreed upon to be carried about,repair charges for stage equipment and props(including cost of necessary repair materials)and laundry fees for stage costumes.

(12)Party B shall ensure that performances and rehearsals of the Troupe be arranged in well-equipped theatres and assisted by stagehands.

6.Remuneration for the Performances

(1)Party B shall pay Party A…U.S.dollars for each night performance and…U.S.dollars for each day performance.Party B agrees that the payment shall be remitted once aweek to China Performing Art Agency:Account No.71401385,Operation Department,Bank of China Headquarters,Beijing,China.

(2)With the consent of both Parties,performance of the Troupe can be filmed,videotaped or televised.Income therefrom shall be equally shared by the two Parties,namely,Party A and Party B shall each get 50%.When televised in other countries,70%of the total income shall go to Party A and 30%to Party B.

7.Party A agrees that preparation for rehearsal and performance shall be made before the Troupe’s arrival in the host country.During the tour,Party B shall provide the Troupe with a suitablerehearsalsite.

8.If a scheduled performance is canceled at the request of the Troupe,Party B shall not be obliged to make the payment as prescribed in subparagraph(1)Paragraph 6 of the agreement.If it is the request of Party B,payment shall still be made according to subparagraph(1)Paragraph6of the agreement.

9.Party A shall provide Party B with a brief introduction of the Troupe,information about its key performers and repertoire and other relevant materials like stage photos.The abovementioned materials(including those produced by Party B)shall not be used for purposes other than advertising during the tour.

Party A shall provide Party B with a name list of theTroupe(name,sex,date and place of birth, position and passport number) and an inventory of equi pment (name, size,weight and value)

10.Party A agrees that members of the Troupe may give interviews to newspaper,radio,television and other media reporters concerning the performances.

Any visual production for the purpose of publicity shall not last more than three minutes.For special shooting arrangement,Party B shall pay Party A service charges.Without the consent of Party A,the performances should not be recorded,videotaped or photographed.

11.Party B agrees to arrange some visits,sightseeing and cultural activities for the Troupe during the tour and bear the related expenses.Party B is also repay to facilitate the arrangement of other friendly activities at the request of the Troupe. In cities where Chinese representatiVe offices are situated,Party B agrees to provide the Troupe with…free admission tickets for the first performance and…for each of the following performances there.

12.Party A shall undertake to complete all the formalities for the exit from and entry intoC hina of Trorpe members and their stage equipment,while Party B is responsible for the formalities of their entry into and exit from…(country).

13.During the tour,neither party shall be responsible for the delay or suspension of performance for reasons beyond their control,such as natural disaster,war,epidemics,strike,domestic unrest,etc.In such cases,Party B shall bear the living expenses of the Troupe as prescribed in the foregoing paragraphs.If performance has to be canceled altogether,Party B shall arrange as soon as possible for the Troupe to return home and cover the cost thereof.
